The state of Utah has initiated legal action against an online contact lens retailer, Lens.com, by filing a lawsuit concerning the company's advertised prices. This legal challenge, centered on what authorities describe as deceptive pricing tactics, sees Utah join forces with both the Federal Trade Commission (FTC) and the Nevada Attorney General. The combined lawsuit specifically targets Lens.com, accusing the company of presenting consumers with misleading information regarding the cost of its contact lenses. The lawsuit was filed in Salt Lake City, according to the Attorney General's office.

Central to the allegations is the accusation that Lens.com initially offered its contact lenses at “artificially low prices” in its advertising. According to the lawsuit, after attracting customers with these initial figures, the company then proceeded to charge them additional "taxes & fees" that were not clearly presented upfront. These undisclosed charges were, the lawsuit states, frequently substantial enough to effectively double the prices Lens.com had originally advertised to its customers. The complaint further alleges that these additional fees were deeply embedded within the online checkout process, making them difficult for purchasers to readily identify or fully comprehend before completing their transactions. This alleged lack of transparency, the filing contends, obscured the true cost consumers would ultimately pay.

The scope of the lawsuit extends beyond the initial purchase price and hidden fees. Lens.com also faces accusations related to its automatic refill subscription plan. The complaint alleges that the company engaged in deceptive pricing practices specifically with this ongoing service. Furthermore, the lawsuit states that Lens.com failed to clearly and conspicuously disclose the necessary information for customers to effectively cancel their enrollment in these automatic refill plans. This alleged omission left customers without transparent guidance on how to terminate an ongoing service they might no longer desire, according to the allegations.

The Utah Attorney General's Office elaborated on the broader implications of these alleged practices. The office stated that such deceptive pricing methods effectively obscure the total price of contact lenses for consumers. This directly impacts customers' ability to accurately determine the actual amount they will be required to pay for their purchases. Consequently, the complaint further alleges, these actions prevent customers from being able to fairly and accurately compare Lens.com’s prices against the offerings of competing contact lens retailers in the market. The ability to make informed purchasing decisions based on transparent pricing is central to consumer protection, a principle the lawsuit seeks to uphold. This joint legal effort aims to ensure that online retailers provide clear and accurate pricing to prevent consumers from being misled by hidden charges or unclear subscription terms.
